Terms and Conditions of Use
General conditions of use of the cluBBart platform

1. Definitions
- "Platform": the cluBBart website, accessible at www.clubbart.it
- "Controller": Barbara Bassani, founder and manager of the Platform
- "User": any natural person who accesses the Platform and/or registers by creating an account
- "Content": all texts, images, documents, listings, comments and any other material published by Users on the Platform
- "Service": the set of functionalities offered by the Platform
2. Subject and acceptance
These Terms and Conditions govern the access and use of the cluBBart Platform, the first Italian digital community dedicated to restoration, art and culture.
Registration on the Platform and use of the Services imply full acceptance of these Terms. If the User does not accept these Terms, they must not use the Platform.
3. Description of the Service
cluBBart is a community platform that offers:
- Professional profiles: showcases for restorers and companies in the sector with portfolio, skills and contacts
- Listings: publication of listings for restoration jobs, training courses and material sales
- Forum: discussion space on techniques, materials, advice and sector topics
- Articles: sharing of articles, theses and research in the field of restoration
- Events: publication and consultation of cultural events (workshops, conferences, exhibitions, etc.)
- Public tenders: consultation of tenders and public procurement in the cultural heritage sector
The Service is provided free of charge. The Controller reserves the right to introduce paid features in the future, with adequate notice.
4. Registration and account
- To access the Platform's features, registration with truthful and up-to-date data is required
- The User must be at least 16 years old
- Each person may create only one account
- The User is responsible for the confidentiality of their login credentials and all activities carried out through their account
- Email address verification is mandatory to complete registration
- Unverified accounts are automatically deleted 24 hours after registration
- Restorer and company profiles are subject to review and approval by the Controller before publication
5. User content
5.1 Content responsibility
The User is solely responsible for the Content they publish on the Platform. The Controller does not exercise prior control over Content, but reserves the right to review, modify or remove any Content that violates these Terms or applicable law.
5.2 Content licence
By publishing Content on the Platform, the User grants the Controller a non-exclusive, free, transferable and worldwide licence to use, reproduce, display and distribute such Content within the scope of the operation and promotion of the Platform.
The User retains all intellectual property rights over their Content.
5.3 Prohibited content
It is prohibited to publish Content that:
- Is illegal, defamatory, offensive, threatening or discriminatory
- Violates third-party intellectual property rights (copyright, trademarks, patents)
- Contains personal data of third parties without their consent
- Is misleading, false or deceptive
- Contains spam, unauthorised advertising or irrelevant promotional material
- Contains viruses, malware or malicious code
- Is contrary to public order or decency
5.4 Anonymous content
The forum allows anonymous posting of discussions and replies. The author's identity remains internally associated with the Content for moderation and security purposes.
6. Applications and contacts between users
The Platform allows the sending of applications and messages related to published listings. The Controller:
- Facilitates contact between users but is not a party to any agreement, contract or transaction between users
- Does not guarantee the quality, safety or legality of services or products offered through listings
- Is not responsible for any disputes between users
Contact details provided in applications (name, email, phone, message) are transmitted directly to the listing author.
7. Intellectual property
All intellectual property rights relating to the Platform (design, logo, source code, graphics, institutional texts) are the exclusive property of the Controller.
The name "cluBBart", the logo and the visual identity of the Platform are protected and may not be used without written authorisation from the Controller.
8. Moderation and suspension
The Controller reserves the right to:
- Refuse or remove Content that violates these Terms
- Suspend or delete accounts in case of serious or repeated violations
- Restrict access to certain features
- Close forum discussions, with indication of the reason
In case of rejection of content submitted for review, the User will receive notification of the reason for rejection.
9. Limitation of liability
- The Platform is provided "as is", without warranties of any kind, express or implied
- The Controller does not guarantee continuous and uninterrupted availability of the Service and reserves the right to suspend it for maintenance or updates
- The Controller is not liable for direct or indirect damages arising from the use or inability to use the Platform
- The Controller is not liable for Content published by Users, nor for information, products or services offered by third parties through the Platform
- The Controller is not liable for data loss due to force majeure or circumstances beyond its reasonable control
10. Communications
By registering on the Platform, the User consents to receiving transactional communications via email relating to their account and use of the Service, including:
- Registration confirmations and email verification
- Content publication confirmations
- Notifications of received and sent applications
- Notifications of replies to own forum discussions
The Controller may also send service communications and informational newsletters relating to the Platform, the restoration and culture sector. The User may unsubscribe from such communications at any time by writing to info@clubbart.it.
11. Account deletion
The User may request the deletion of their account at any time by writing to info@clubbart.it.
In case of deletion:
- Personal account data will be deleted within 30 days
- Already published Content may be anonymised and retained to ensure the integrity of discussions and Platform archives
- Uploaded images and files will be deleted
12. Applicable law and jurisdiction
These Terms are governed by Italian law.
For any dispute relating to the interpretation or execution of these Terms, the Court of the place of residence or domicile of the consumer User shall have jurisdiction, pursuant to Legislative Decree 206/2005 (Consumer Code).
13. Changes to the Terms
The Controller reserves the right to modify these Terms at any time. Changes will be published on this page with an indication of the last update date. Continued use of the Platform after the publication of changes constitutes acceptance thereof.
